Share Your Feedback on Proposed Licensing Law Changes

PAR is proposing major changes to the Pennsylvania real estate licensing law, and we’d like your feedback on the potential changes.  

These proposed revisions aim to modernize several key areas of the licensing law, including real estate teams, advertising and licensing requirements that reflect the evolution of our industry. The goal is to ensure the statute more accurately aligns with the current realities of real estate practice across the commonwealth. 

The recommendations are the result of more than two and a half years of work by the RELRA Task Force. Once the task force completed its work, the proposed recommendations were handed off to PAR’s Legislative Committee, which I have the privilege of chairing. After extensive discussion and review, the committee voted to move forward with a comprehensive effort to modernize the licensing statute. 

Our committee’s recommendations are broken down into nine sections, covering different aspects of the current licensing law. Members can review all the recommendations, but I want to highlight some of the more notable recommendations. 

  • The Legislative Committee is proposing the creation of a provisional license category for all new licensees which would require additional continuing education coursework post licensure. Provisional licensees would be subject to certain restrictions while holding this license. 
  • We also are proposing actually defining “advertising,” which is not currently addressed in the statute, and a shift to use license number in place of brokerage phone number in advertising. 
  • We are making several recommendations for real estate teams, as teams are not currently addressed in the statute. These include: 
    • Defining a team.
    • Requiring each team to have a “team supervisor” who would have some level of administrative and supervisory responsibilities. 
    • Team supervisors can be brokers, associate brokers or real estate salespersons who complete 60 hours of broker continuing education (Real Estate Office Management and Real Estate Law) and have transactional experience equivalent to one-half of the amount of experience needed to sit for the brokers exam. 
    • Requiring that each real estate team have a unique license number tracked by the Department of State. 

Of course, any major changes to the licensing law will have a serious impact on the real estate industry across the commonwealth. That’s why we are asking for your feedback. Your feedback will help guide the final recommendations that will be presented to PAR’s Board of Directors. Your input will help ensure the industry speaks with a strong, unified voice.
