HB 1325 alleviates on-lot sewage issues in high quality watersheds

Recently proposed changes regarding on-lot sewage systems in high quality and exceptional value watersheds will be resolved with the passage of House Bill 1325 last week. The bill is headed to Gov. Corbett’s desk for his signature.
The Department of Environmental Protection (DEP) recently issued proposed guidance, “Sewage Facilities Planning Module Review for On-Lot Sewage Systems Proposed in High Quality and Exceptional Value Watersheds,” which would have made land adjacent to lakes and streams undevelopable and restricted in use.
HB 1325, sponsored by Rep. David Maloney (R-Berks), will alleviate the problems by allowing already approved on-lot sewage systems to be used in areas that have degradation issues.
“We’re pleased the legislature has approved a solution which is a reasonable solution for homeowners,” said Bette McTamney, the Pennsylvania Association of Realtors® (PAR) president. “HB 1325 provides a common-sense, cost-effective approach to mitigate watershed pollution.
“PAR has been fortunate that fellow Realtor® Bob Wood has been monitoring this issue and alerted us to the potential problems with DEP’s guidance,” McTamney added. Wood from Mansfield represents PAR on DEP’s Sewage Advisory Committee and its task force. Wood provided input in drafting the committee’s solutions.
